Summary

A person or entity that acquires an AED shall ensure that expected users be trained in CPR/AED, notify EMS of AED type and location, and ensure that the AED is maintained and tested according to the manufacturer's guidelines.

The law provides Good Samaritan immunity for the rescuer and person or entity responsible for AED acquisition or for the location the AED is located or used. CPR/AED trainers and medical directors are also covered.

AEDs are required in health spas and schools.

Students in grades 9-12 must take non-certification CPR/AED training.

A.C.A. § 6-16-142 Training Requirements 2014-09-01 Beginning with the 2014-2015 school year, a public school student in grades nine through twelve (9-12) shall be trained in cardiopulmonary resuscitation before the student graduates from high school. CPR course can be non-certification and must include instruction on AED use.
A.C.A. § 6-10-122 Mandate 2006-06-12 The law requires an automated external defibrillator placement on each school campus in Arkansas. Appropriate school personnel should be adequately trained. AED should be made available for school-related activities, such as athletic events.
A.C.A. § 20-13-1304 Training Requirements; Registration Requirements; Other Requirements A person or entity that acquires an AED must ensure that: (1) expected AED users complete appropriate knowledge and skills courses at least one time every two years in CPR and AED use; (2) the defibrillator is maintained and tested according to the manufacturer's operational guidelines and instructions; and (3) any person who renders emergency care or treatment on a person in cardiac arrest by using an AED activates the emergency medical services system as soon as possible and immediately reports any clinical use of the AED to the medical provider responding to the emergency. Any person or entity that acquires an AED shall notify an agent of emergency communications, 911, or vehicle dispatch center of the existence, location, and type of automated external defibrillator.
A.C.A. § 20-13-1306 Mandate The law requires automatic external defibrillators in health spas.
A.C.A. § 20-13-1305 Good Samaritan The law limits civil liability under certain circumstances of use, or an attempted use, of an AED. Any person or entity that in good faith and without compensation renders emergency care by the use of an AED is immune from civil liability for any personal injury as a result of any act if the person acts as an ordinary, reasonably prudent person would have acted under the same circumstances. The immunity from civil liability for any personal injury includes the person or entity responsible for the location where the AED is located or used.
